1. Acceptance of Terms

By creating an account or using Tenatur ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Tenatur. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Tenatur is an AI-powered property inspection platform that enables landlords, property managers, and tenants to:

  • Conduct move-in and move-out property inspections using photographs.
  • Use artificial intelligence to identify items and assess property conditions.
  • Generate inspection reports with condition ratings, photo evidence, and digital signatures.
  • Calculate security deposit deductions based on condition changes.
  • Share and download inspection reports as PDF documents.

3. User Accounts

You must create an account to use the Service. You agree to:

  • Provide accurate and complete information when creating your account.
  • Maintain the security and confidentiality of your login credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

You must be at least 18 years of age to create an account.

4. Consent to Communications

By creating an account, you expressly consent to receive:

  • Transactional emails: Account confirmations, inspection reports, password resets, and service notifications necessary for the operation of your account.
  • Commercial emails: Marketing communications from Tenatur including product updates, feature announcements, usage tips, and promotional offers from Tenatur and selected third-party partners whose products or services we believe may be relevant to property owners and managers (such as property management tools, maintenance and repair services, insurance products, cleaning services, and landlord resources).

This consent is provided in accordance with Canada's Anti-Spam Legislation (CASL) and the U.S. CAN-SPAM Act. You may withdraw your consent for commercial emails at any time by clicking the "Unsubscribe" link in any promotional email or by contacting us at privacy@tenatur.com. Withdrawal of consent for commercial emails will not affect transactional emails necessary for your account.

5. AI Analysis and Accuracy

The Service uses artificial intelligence to analyze inspection photos and provide condition assessments. You acknowledge and agree that:

  • AI analysis is provided as an assistive tool and may not be 100% accurate.
  • You are responsible for reviewing and confirming or correcting AI-generated assessments before finalizing any inspection report.
  • Tenatur does not guarantee that AI assessments will be accepted as evidence in legal proceedings. The admissibility and weight of any inspection report is determined by the applicable court or tribunal.
  • Your corrections to AI assessments may be used to improve the accuracy of the AI system, as described in our Privacy Policy.

6. Your Content

You retain ownership of all content you upload to the Service, including photos, notes, and inspection data ("Your Content"). By uploading content, you grant Tenatur a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service to you.

You represent that you have the right to upload all content you submit and that Your Content does not violate any third party's rights.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that is fraudulent, misleading, defamatory, or infringes any intellectual property rights.
  • Attempt to access other users' accounts or data without authorization.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automated tools to scrape, crawl, or extract data from the Service.
  • Resell, sublicense, or redistribute the Service without our written consent.

8. Fees and Payment

Tenatur offers a free tier that allows you to complete inspections at no cost. If we introduce paid plans in the future, we will provide clear pricing information and obtain your agreement before charging any fees. Paid plans, if offered, will be billed in advance on a recurring basis unless cancelled.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI condition assessments will be accurate, complete, or suitable for any particular legal purpose.
  • Inspection reports generated by the Service will satisfy the requirements of any specific jurisdiction or legal proceeding.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TENATUR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

11. Indemnification

You agree to indemnify and hold harmless Tenatur and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may terminate your account at any time by contacting us at privacy@tenatur.com. We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period as described in our Privacy Policy, including to support the legal defensibility of inspection records.

13. Governing Law and Disputes

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Service shall be resolved in the courts of Alberta, Canada.

For users in the United States: you agree to resolve any disputes with Tenatur through binding arbitration on an individual basis, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tenatur regarding the use of the Service and supersede any prior agreements.
